License Agreement
The Distillery Operations (All 1.xx Versions) software
package, which includes the executable program and all its accompanying
documentation, is Copyright © 2010-2016 by Payton Fireman.
End User License Agreement: This end-user license agreement
for Distillery Operations ("Software ") is a legal agreement between
you (either an individual or an entity) and Payton Fireman ("Author or
Licensor"). You agree that your use of the software product acknowledges
that you have read this license, understand it, and agree to be bound by its
terms and conditions. . If you do not agree to all the terms and conditions of
this agreement, do not use the program or any accompanying documentation, and
delete them from your computer and contact Author for a refund of your purchase
price.
1. Grant of License: The Software is licensed, not sold, to
you by Author for use only under the terms of this license, and Author reserves
any rights not expressly granted to you. Author grants to you a personal,
non-transferable and non-exclusive right to use the copy of the software
product provided with this license. The license Authorizes you to use one copy
of the version of this software product on a single computer and to make a
backup copy in the event the original is corrupted. With this license you are
granted a one-year period of upgrades to any new versions released within 12
months of your purchase date.
2: Trial Versions: Distillery Operations is copyrighted
software, but the try-before-you-buy evaluation version can be freely
distributed. The evaluation version has all the functionality of the full
version, except that it will operate for only 5 runs. When you purchase the
full version you will receive a license file by email which you can install and
which will remove this restriction.
3. Disclaimer of warranty and liability: This Software is
provided on an "as-is" basis, without warranty of any kind. The
Author disclaims all warranties and shall not be liable for any damages of any
kind, relating to this software, whether expressed or implied, including but
not limited to any implied warranties of merchantability or fitness for a
particular purpose. Neither Author nor anyone else who has been involved in the
creation, production, or delivery of this software shall be liable for any
direct, indirect, consequential, or incidental damages arising out of the use
or inability to use such software. The person using the Software bears all risk
as to the performance of the software. If you do not agree with this, or if
this type of agreement is not allowed in your area, then you should not use or
purchase this software. In any event whatsoever, the entire liability of Author
for any reason, shall be limited to the amount paid for the program license.
4. Your Responsibility When Using Distilling Operations
Software: This program is not a substitute for a sound and through
understanding of the laws and regulations governing distilled spirits plants
and the processes of blending and rectifying alcohol. Licensor has done his
best to give you useful information about the properties of alcohol being
processed based on table lookups of those properties and rote execution of
approved algorithms of blending. The user must ensure that the procedures they
wish to carry out are ones intended, that accurate inputs are provided, and
that the results are checked by an independent source prior to execution. This
program should be considered as a back up to the present procedures of your
distilled spirits plant. You should consider it as a trial program until you as
the user are absolutely sure that the algorithm in question is reliable for
your purposes. Even then you must continue to use the gauging manual and other
alternative procedures to verify that the program delivers consistent results
for your particular application. Blending alcohol is an exacting and
non-forgiving art. The user is required to maintain a current understanding of
the regulations, procedures, and requirements for operating a distilled spirits
plant and be aware of changes in tax rates and other regulation changes that
may affect features of the program.
5. No refunds: One week after purchase, no refund will be
given, unless Authorized by the Author.
Under unexpected circumstances the Author reserves the right to provide
refunds, or make any commercially reasonable efforts to solve any issues at his
discretion. Please contact the Author to see if you qualify for a refund.
6. Exceptions: No exceptions to any portion of this license
agreement will be allowed without the express written permission of the Author.

7 General Provisions: Said software and manual are protected
by United States copyright laws and by international treaty provisions. Failure
to comply with all terms, restrictions and conditions shall constitute breach
